Terms of Service (T.O.S Page)

General

  • I reserve the right to refuse a commission from anyone, I am not obligated to give a reason for refusal.

  • Delivery ETA's can be effected by queue! You will be updated if Artistree ETA is going to go past the 2, 3 or 4 week marks.

  • I am a student and work on commissions in my free time. There will be times/days when I am not available for back-and-forth conversations.

  • My physical health impacts my work directly, all commissioners are the first top be informed and a plan is worked out individually.

  • You must be 18 years or older to commission me.

  • Only with proof of their consent will I draw other peoples characters, said character must be connected to your own.

Intellectual Property Rights / Use

  • I reserve the right to display, show live process and post all stages of a commission on social media/website/livestream/video unless agreed upon otherwise.

  • You may request commissioned work not be posted for additional privacy reasons.

  • You may NOT modify my work unless under special circumstances, If a change is needed, I am not opposed to making minimal good faith detail revisions.

  • Your commissioned piece(s) are to be used for personal, non-commercial use without fee; rights for present and/or future commercial use may be discussed.

  • You may not distribute commissioned art commercially or directly profited off it unless we have agreed upon circumstances.

  • At any point in it’s process, my Artwork and/or Commissioned Pieces shall not be, under any circumstances used to train AI and/or turned into an NFT.

  • I reserve the right to watermark my work throughout the entire process as I see fit.

  • For my protection and integrity, my watermark is NOT to be removed.

  • Full artist credit includes and is not limited to: Proper artist credit given in an embedded tag to profile or linked credit to “ https://Kirinopal.carrd.co “ or simply "Kirinopal" when latter is unavailable.

Prices / Payments / Fees

  • Payments done via an Invoice from me are only via PayPal, however Artistree does accepts other payment types like credit, debit and venmo.

  • Payments are always due in Full when commissioning via Invoice, unless otherwise agreed upon.

  • Artistree is preferred payment method.

  • If no Reference Sheet or Flat color art of character or photo (real life people commissions) can be provided, I will suggest returning with references or commissioning a Custom Design Commission from me instead if applicable.

  • Adding another Character to a commission will cost 100% of the original price of type of commission, per additional commission type.

  • I charge a Flat Commercial Use Fee of double the total commission price and Full Artist Credits to be given.

  • Complexity fee of 10% on total price, may apply for complex designs and/or background aspects in special cases.

Revisions / Refunds

  • A reasonable amount of revisions can be made, please give clear feedback during updates to minimize revision rounds.

  • Reasonable Minimal Revisions are revisions considered non-invasive to revise on a piece in its current state.

  • Invasive Revisions are revisions that change aspects of a piece that are invasive to revise.

  • It's my responsibility to make creative suggestions and work with your given feedback and make reasonable fixes to work towards the end product together; It is your responsibility to provide feedback and ask for revisions within the appropriate revisions periods.

  • Custom Design Work is locked to Three Revision Rounds with no chance of additional revision requests.

  • If refund is needed, please make me aware immediately, refunds are no longer available to be fulfilled past certain points within the process.

  • Excessive revision requests/Invasive Revisions can result in the delayed delivery of the commission and may result in cancellation If deemed excessive at my discretion.

Commission Types:
Preset Commission Types are available on Artistree.
"Build-Your-Own-Commission" format is for commissions that fall outside of Preset Commission Types.Custom Design Work:
You will provide a relatively detailed written description of the desired design of the character, (example: hair / fur / skin color, species, skin, coat and or body color) Mood boards, aesthetic collages, reference photos, traditional paper sketches, and themes are welcomed and encouraged in addition to a written description.Custom Design into Reference Sheet:
We work together to develop a sketchy design of your character, (read Revision T.O.S section). Then that design will be drawn into a default Base Reference sheet assets.
All additional reference sheet assets will done in same chosen style.The more visual references given the less chance of major revisions being needed to reach clients desired outcome, You will have three revision rounds before I charge additional revision fees.Estimated Turnaround Time:
Upon commission confirmation you will be provided/are provided with an estimated Turnaround Time. (Public Carrd Queue available, Artistree Queue available, Private Progress Table upon request).I take a set amount of commissions at a time, estimated turnaround time depends of commission type. Estimated 2 ½ weeks for middle ground project and 3-4 weeks or more for larger, more involved projects.If ETA gets extended you will be told ahead of time and given a Private Progress Table (detailed progress list updated thoughout pieces completion).More Involved Commission Types:
*Group Scenes, Custom Designs, Custom Designs into Reference Sheets, Commissions with Detailed BGs, Duo Fullbody Commissions.Visual Updates:
Throughout commission process, Visual Updates will be given for large progress milestones via first method of contact. During these Visual Updates I will show you how the commission looks, inform you about what’s happening next and discuss any feedback or revisions you may have.Queue / Progress Table:
A Public Queue is available both carrd page and via Artistree Queue.Under particular circumstances, a Progress Table (a continuously edited checklist that gets updated as progress is done) may be provided to you if delays/situations occur via direct messages.Response Times:
